These Terms of Service (“Terms”) govern your use of the Portio AI mobile application, website, and related services (the “Service”) provided by APLUSTEACHING LTD (“we”, “us”, or “our”).

By accessing or using Portio AI, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You may use Portio AI only if:

• You are at least 9 years old, and
• You are allowed to use apps and online services under the laws of your country or region.

If you are under the age at which you can enter into a contract in your country, you should only use the Service with the permission and supervision of a parent or legal guardian, and they are responsible for your use of the Service.

3. Your account

To use certain features, you may need to create an account.

You agree to:

• Provide accurate and up-to-date information.
• Keep your login details (email and password) secure.
• Notify us promptly if you believe your account has been accessed without your permission.

You are responsible for all activity that happens under your account.

4. Use of the Service and prohibited uses

Portio AI is provided for personal use to help you track calories, protein, and other nutrition based on your meals and profile information.

You agree that you will not:

• Use the Service for any illegal or unauthorized purpose.
• Try to hack, attack, or overload the Service or our systems.
• Attempt to bypass security measures or access data you are not allowed to access.
• Reverse engineer, decompile, or attempt to extract the Service’s source code.
• Use the Service to harass, abuse, or harm others.
• Upload content that is unlawful, offensive, or infringes on someone else’s rights (for example, photos you do not have permission to share).

We may monitor use of the Service to protect our users and our systems.

5. Health and nutrition disclaimer

Portio AI does not provide medical advice.

• Calorie and nutrition values are estimates and may be incomplete or inaccurate.
• The Service is not designed to diagnose, treat, cure, or prevent any disease.
• The Service is not a substitute for professional medical or nutritional advice.

Always consult a doctor, nutritionist, or other qualified health professional if you have questions about your health, diet, or medical condition. You are responsible for how you use any information from the Service.

6. User content

You may upload photos of your meals, enter food logs, and provide other information (together, “User Content”).

You keep ownership of your User Content. However, by using the Service you give us a limited license so we can operate the app:

You grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content only to:

• Analyze your meals,
• Estimate calories and nutrition,
• Show your history and progress, and
• Operate, maintain, and improve the Service.

We do not publicly display your meal photos or logs.

You are responsible for ensuring that:

• You have the right to upload the content; and
• The content does not violate any laws or someone else’s rights (for example, uploading photos of other people without their consent).

7. Subscriptions, billing, and in-app purchases

Portio AI may offer free features and paid subscriptions or in-app purchases.

• Payments and subscriptions are handled by the App Store (Apple).
• The App Store’s terms and policies apply to payment processing, renewals, cancellations, and refunds.
• Subscriptions may automatically renew unless you cancel them in your App Store account settings before the renewal date.

We do not control the App Store’s billing system or refund rules. To manage or cancel a subscription, you must use your App Store account settings.

8. Third-party services

The Service may contain links or integrations with third-party services (for example, the App Store or social media platforms).

We do not control these third-party services and are not responsible for:

• Their content,
• Their availability, or
• Their privacy and security practices.

You should review the terms and policies of any third-party services you use.

9. Intellectual property

All rights in Portio AI and the Service (including the app, design, text, graphics, logos, and underlying software) belong to APLUSTEACHING LTD or our licensors.

You may not:

• Copy, modify, resell, or distribute any part of the Service.
• Reverse engineer or attempt to extract the source code.
• Use our name, logo, or branding in a way that suggests endorsement without our written permission.

10. Termination and suspension

We may suspend or terminate your access to the Service, with or without notice, if:

• You violate these Terms,
• We are required to do so by law, or
• We decide to discontinue the Service.

You may stop using the Service at any time and, where available, delete your account in the app.

When your access is terminated:

• Your right to use the Service ends.
• We may retain some information as described in our Privacy Policy and as required by law.

11. “AS IS” and “AS AVAILABLE” disclaimer

The Service is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we do not make any warranties or guarantees that:

• The Service will always be available or error-free,
• The information provided by the Service will always be accurate or complete, or
• The Service will meet your expectations or be suitable for every purpose.

You use the Service at your own risk.

12. Limitation of liability

To the maximum extent permitted by law:

• APLUSTEACHING LTD and its directors, employees, and partners are not liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, arising out of or in connection with your use of the Service.
• Our total liability for any claim related to the Service will be limited to the amount you have paid to use the Service in the three (3) months before the event giving rise to the claim, or, if you have not paid anything, to the minimum amount required by applicable law.

Some jurisdictions do not allow certain limitations of liability, so some of the above limits may not apply to you.

13. Governing law

These Terms are governed by the laws of Saudi Arabia, without regard to conflict of law rules.

Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Saudi Arabia, unless local law requires a different court.

14. Changes to these Terms

We may update these Terms from time to time.

• When we make changes, we will update the “Last Updated” date at the top of this page.
• If you continue to use the Service after the updated Terms become effective, you agree to the new Terms.

If you do not agree to the updated Terms, you must stop using the Service.
